Terms and Conditions – Mobile / Web Application

Applicability:
These Terms and Conditions shall be applicable to all users (hereinafter referred as “I/ We/ Me/ Us/ My/ Our”) who access and use the mobile/ web application operated by the Aditya Birla Housing Finance Limited (hereinafter referred to as "ABHFL”) for availing services offered by the Company from time to time.

Declaration:
I/We hereby declare that the details furnished by me / us on this loan application are true and correct to the best of my knowledge and belief and I undertake to inform you of any changes therein, immediately. In case any of the above information is found to be false or untrue or misleading or misrepresenting, I am aware that I may be held liable for it.

I /We confirm that no insolvency proceedings or suits for recovery of outstanding dues or monies whatsoever and/ or any criminal proceedings have been initiated and /or are pending against me/ us and that I/We have never been adjudicated insolvent by any court or other authority.

No action nor other steps have been taken or legal proceedings started by or against me/us in any court or law/other authorities for winding up, dissolutions, administration or reorganization or for the appointment of the receiver, administrator, administrative receiver, trustee or similar officer for my /our assets.

I/We declare that I/We have not made any payments in cash, bearer cheque or kind along with or in connection with this application to the executive collecting my/our application. I/we shall not hold Aditya Birla Housing Finance Ltd. (hereinaſter referred to “ABHFL”) liable for any such payments made by us to the executive collecting this application.

I/We understand and acknowledge that ABHFL shall have the absolute discretion, without assigning any reasons (unless required by applicable law) to reject our application and ABHFL shall not be responsible in any manner whatsoever to me/us for such rejection or any delay in notifying me /us of such rejection and any costs, losses, damages or expenses, or other consequences, caused by reasons of such rejection, or any delay in notifying me/us of such rejection, of our application.

I/We understand and am/are aware that the processing fees collected from me/us by ABHFL, is for the purpose of ABHFL reviewing this loan application as per its own parameters and is not refundable to me/us under any circumstances whatsoever, irrespective of whether ABHFL sanctions this loan application of mine or not.

I/We confirm that I /we shall not use the products or the credit /loan facility(s) (or any part thereof) for any improper/illegal or unlawful purpose/ activities.
I/We shall inform to ABHFL regarding any changes in my /our address(s) or my employment or profession.
I/We am/are aware of the Fair Practices Code and Policy for determination of Interest Rates, Processing and Other charges adopted by ABHFL which is placed on ABHFL's website homefinance.adityabirlacapital.com.
I/We am/are aware of the various products offered by ABHFL, its features, loan limits and cost, etc., which is placed on ABHFL’s website homefinance.adityabirlacapital.com.
I/We hereby confirm that I/we am/are competent and fully authorized to give declarations, undertaking etc. execute and submit this application and all other documents or information for the purpose of availing the loan, creation of security and for all the purposes mentioned /required to be done for this.
I/We confirm that I/we shall cooperate with ABHFL and furnish additional documents / information and/or execute such other documents, if necessary to enable ABHFL to abide by/comply with all other existing /further directives of the statutory /regulatory authorities/any other authority acting under any Law.
I/ We hereby understand that the Aadhaar number and biometric data will not be stored in the systems associated with the mobile/ web application.
I/ We hereby agree that I have read and understood the guidelines specified by ABHFL regarding storage of data, restrictions on use of data, data destruction protocol and standards for handling security breaches, specified in the Privacy Policy of ABHFL.
I/ We understand that if at any point of time during or after the service, I/We have any concerns regarding the mobile/ web application, I/We can contact the Grievance Redressal team in line with the grievance redressal mechanism available in the mobile/ web application and on website.

Consent
I/We hereby give consent to the ABHFL or its Authorized Agents and third party service providers to use information/data provided by me to contact me through any channel of communication including but not limited to email, telephone, sms, whatsapp etc. and further authorize the disclosure of the information contained herein to its affiliates/group companies or their Authorized Agents or Third Party Service Providers in order to provide information and updates to me on various financial and investment products and offering of other services.

I hereby authorise the respective ABC Companies and their authorised agents/service providers to reach out to me with regard to various financial products and services (‘Purpose’) offered by the subsidiaries of Aditya Birla Capital Ltd. (‘ABC Companies’). I confirm that this authorisation shall override my NDNC registration and I can be contacted through any channel of communication including but not limited to email, telephone, sms, whatsapp or any other similar mode for the above Purpose.

I/We Agree that all personal or transactional related information collected/provided by me can be shared/transferred and disclosed with the abovementioned parties including with any regulatory, statutory or judicial authorities / credit bureaus for compliance with any law or regulation in accordance with the Fair Practices Code and Privacy Policy as available at the website of the ABHFL.

I/We hereby consent to receiving information from Central KYC Registry through SMS/Email on the above registered number/email address and to carry out requisite checks by such processes as may be permissible under the law including verification of documents / details submitted for KYC purposes towards my / our loan application accessing and procuring data from databases maintained by statutory or other authorities constituted by law.

I/We, hereby submit voluntarily at my / our own discretion, physical copy of Aadhaar letter or downloaded Aadhaar (e-Aadhaar) or offline electronic Aadhaar XML as issued by Unique Identification Authority of India (UIDAI) to ABHFL or allow ABHFL to perform Aadhaar authentication, for the purpose of establishing my identification/ address proof, in individual capacity or as an authorized signatory in case of non-individual borrower, as the case may be and; hereby consent to ABHFL for its verification to establish its genuineness through such verification modes acceptable as per UIDAI or under any Act or law, from time to time. I / We, further confirm that the purpose of collecting Aadhaar has been explained to me / us and ABHFL has informed that my demographic information and any other information shall not be used for any purpose other than for the purpose of verification, or as per requirements of law. I, further agree to have been sufficiently informed by ABHFL about other alternative documents that can be submitted for establishing proof of identification and address.

I/We hereby provide our consent to ABHFL to obtain my / our information / personal data from Credit Information Company and/or information utility and/or such institution set up under the provisions of law from time to time, as and when required.

I hereby authorise Aditya Birla Housing Finance Limited as the lender and the respective ABC Companies and/ or their authorised third-party service providers to receive, collect, store and verify my credit information from any of the credit bureaus and bank statements for income verification for processing my loan application and providing relevant products/services. I confirm that this authorisation shall override my NDNC registration and I can be contacted through any channel of communication including but not limited to email, telephone, sms, whatsapp or any other similar mode for the above Purpose.

Please note that all above consents /authorisations provided are voluntarily and shall remain valid and subsisting until withdrawn.

IMPORTANT NOTE - The receipt of your loan application does not imply automatic approval of your loan by ABHFL. ABHFL may request for additional documents other than those in connections with the application. I/We confirm that executive who collected my /our applications/ documents has informed me/us and I/we am/are fully aware:

That government tax as may be applicable from time to time will be charged in connection with the Loan.
That ABHFL will not be liable for loss or delay in receipt of the documents.
That incomplete/defective applications will not be processed and ABHFL shall not be responsible for any manner for the resulting delay or otherwise
That the applications forms, documents/ photographs will not be returned under any circumstances once submitted to ABHFL.
That approval for the applications is the sole discretion of ABHFL.
That the quantum of the loan will be finally decided by ABHFL and ABHFL has not made any commitment to me/us regarding the same.
That equated installments (EMI) will be due on 5th / 10th of every month (will be mentioned in sanction letter)

The Most Important Terms and Conditions mentioned above are an indicative list of terms and conditions of our loan products. These Terms and Conditions are further described in our loan agreement under relevant sections /schedules and therefore should be read in conjunction with those mentioned in the loan agreement.

Declaration and Terms & Conditions for usage of features and functionality provided by FinFort Infotech LLP

The use of this Borrower Portal and its features and functionality (Application) provided by FinFort Infotech LLP (FinFort) shall be governed by the following Terms of Use (Agreement).

You as an individual, or as a representative authorised by the individual to accept the Terms of Use and use this Application, or as a single user with authority on behalf of the organization you represent to accept the Terms of Use and use this Application, agree that You have read and agree to be bound by the terms and conditions of this Agreement. If You do not unconditionally agree to all of the terms and conditions of this Agreement, You are requested not to use the Application for upload / download of content or any other purpose.

This Application is the property of FinFort and is protected by Intellectual Property and copyright laws. FinFort grants You a non-exclusive, non-transferable, limited right to access this Application for Your personal and non-commercial use. You shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Application.

FinFort reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Application (or any part thereof) with or without notice. You agree that FinFort shall not be liable to You or to any third-party for any modification, suspension or discontinuance of the Application

The application and the content on this application are provided “as is” and all warranties and conditions, express, implied, and statutory, including without limitation the implied warranties of title, non-infringement, merchantability, fitness for a particular purpose or use, accuracy or completeness, satisfactory quality, and quiet enjoyment, or other warranties or conditions arising by statute, operation or law, course of dealing, usage of trade or otherwise are hereby disclaimed. Some jurisdictions do not allow the limitation or exclusion of implied warranties, so the above limitations may not apply. FinFort does not warrant that the use of the application software or services will be uninterrupted or error free or that the application and the content on this application do not contain any viruses.

FinFort is providing this Application to You only as a convenience to provide Your Information to the Lender. To extract Your Information, You will be directed through the FinFort remote desktop to an external application, website or portal maintained by an entity other than FinFort. Upon Lender request, FinFort will provide customer service support in “view only” mode on the FinFort remote desktop. If You agree to key in your credentials and password for this external application, website or portal, You do so at Your own risk and it is Your responsibility to take all protective measures to guard against viruses or any other destructive elements. There is no warranty of any kind, express or implied, regarding third party application or portal and its content. FinFort does NOT have access to your Login Credentials

FinFort does not claim ownership of the content You download / provide and FinFort will retain and use the same for providing the credit evaluation reports for the Lender. By inputting and submitting Your Login Credentials You are granting FinFort permission to use Your content including but not limited to profile information, status of Your Income Tax returns, tax demands, all returns and all Your other information and documents available on the Income Tax website and Form 26AS from the TRACES website, GST website required in connection with providing the credit evaluation reports for the Lender. FinFort may use such information for its other business and / or analytical purposes, by anonymizing and aggregating Your Information with other similar information. You hereby acknowledge and agree that no compensation shall be paid or no future commercial consideration will accrue to you with respect to the use of Your Information by FinFort.

In no event shall FinFort be liable to any entity for any direct, indirect, consequential or other damages including, without limitation, any lost profits, business interruption, loss of information etc. that are related to the use of, or the inability to use, the content and functionality on this Application or any linked Application.

You agree to indemnify and hold harmless FinFort from any claim, cost, expense, judgment or other loss relating to Your use of this Application in any manner including any action n You take which is in violation of the terms and conditions of these Terms of Use and against any applicable law.

This Agreement shall be governed by the laws of India.
